The Proverb "Applicable for All Times and Places" Between Textual and Contextual Traditionalists: A Comparative Study of Fiqhi Interpretations

Abstract

The rapid pace of modernization confronting contemporary Muslim societies has compelled Islamic scholars and thinkers to intensively engage with aligning religious practice and shariah frameworks with modern realities. Amid secular ideological shifts, the operationalization of the Islamic axiom "Applicable for All Times and Places" (Salih Likulli Zaman wa Makan) has emerged as a central point of intellectual discourse. While diverse viewpoints exist, this study categorizes the overarching intellectual divide into two primary currents: "Textual Traditionalists" and "Contextual Traditionalists." These factions fundamentally diverge on the conceptualization of Ta'abbudi (unreasoned devotion), the rationality of Shariah, and the boundaries of fixed (Thawabit) and variable (Mutaghayyirat) rulings. This divergence stems from distinct epistemological and methodological principles, particularly regarding non-ritualistic, explicit textual rulings (Nass Qat’i) such as Qisas (retribution), Hudud (penalties), polygamy, and inheritance. Textual traditionalists strictly adhere to the literal and manifest meanings of the Quranic text. Conversely, contextual traditionalists prioritize Illah (effective cause) and historical-critical contextualization, arguing that the practical application of text-bound rulings is subject to spatial and temporal shifts. Utilizing a qualitative, descriptive, and analytical library-based methodology, this research addresses the foundational motives driving both paradigms, the underlying causes of their deep polarization, and the ideal framework for modern Muslims to navigate this intellectual dichotomy. Ultimately, this paper seeks to formulate a balanced paradigm that addresses the demands of modernity while meticulously preserving the authenticity, heritage, and core substance of Shariah, reinforcing the true essence of Islam’s eternal applicability.
